Definitions

  1. “Customer / user / you” means you, as purchaser of the Service.
  2. “Account” an account registered in our Service by Customer.
  3. “Data Policy” refers to the Provider’s standard policy for storage and deletion of data, posted on the Website, as such a policy may change from time to time.
  4. “User Content” refers to written and graphic content provided by Customer, including text, photographs, product codes.
  5. “Privacy Policy” refers to the Provider’s privacy policy, posted on the Website, as such a policy may change from time to time.
  6. “Service / Fridger” refers to the Provider’s online service. The service includes such functions as stated on the Website, which the Provider may change from time to time, at its sole discretion.

General

  1. By downloading or using the Fridger app, these terms will automatically apply to Customer – you should make sure therefore that you read them carefully before using the Fridger app.
  2. You’re not allowed to copy or modify the Fridger app, any part of the Fridger app, or our trademarks in any way.
  3. You’re not allowed to attempt to extract the source code of the Fridger app, and you also shouldn’t try to translate the Fridger app into other languages or make derivative versions.
  4. Any rights to the Mobile Application, in particular - but not exclusively - copyrights to the elements of the Mobile Application belong to the Service Provider.
  5. For the correct and effective use of the Mobile Application, it is necessary for the User to use at least a Mobile Device based on the iOS operating system (at least version 10.0) or Android (at least version 5) or newer, while this device should be simultaneously connected to the Internet and equipped with a camera that allows taking pictures and scanning Product Codes. The User, for the proper functioning of the Fridger app, should allow the Mobile Application to access the device's camera (taking pictures). The Mobile Application uses an Internet connection in its operation - the costs of connecting to the Internet are charged to the Renewable Subscription User in accordance with the contracts concluded by the User with the telecommunications operator of his choice.
  6. The Service Provider reserves the right to interrupt, malfunction or lack of access to the Mobile Application in the event that the User of the Renewable Subscription does not meet the requirements described in the preceding point or in the event that he fails to pay the renewable subscription for subsequent periods.
  7. If a new version of the Mobile Application is created, the User of the Renewable Subscription should update it. If the User of the Renewable Subscription does not have the current version of the Mobile Application, the Service Provider reserves the right to malfunction or inaction of the Mobile Application.
  8. The User may not use the Renewable Subscription of the Mobile Application or any of the services provided by the Service Provider in a manner inconsistent with generally applicable law or decency or public morality or violating anyone's personal rights.
  9. Access to the Mobile Application and its content in an automated manner is prohibited, in particular it is prohibited to use bots, data-downloading machines, indexing robots or other automated tools enabling the use of the Mobile Application without the participation of a Renewable Subscription User.
  10. The User of a Renewable Subscription may use the Mobile Application only for purposes not directly related to his business or business activity. In particular, this means that the Renewable Subscription User is not entitled to use the Mobile Application for commercial and commercial activities. The person using the Mobile Application declares that he or she meets the definition scope of the "Renewable Subscription User" referred to in these Regulations.

Our Service

  1. Fridger app helps Customers track their food expiry dates and may suggest dishes that you can prepare from it. To do so, we process the information provided by users to detect product types and names based on photographs, product codes and other information provided by the Customer.
  2. Fridger allows you to track your groceries expiry dates simply by adding their photographs, scanning product codes visible on a packaging or providing other information. Anything that you add is referred to as "User Content" You retain all rights in, and are solely responsible for, the User Content you add the Fridger. We will not publish or share any User Content with any third parties.
  3. The Mobile Application operates 24 hours a day, 7 days a week, excluding the Mobile Application failure time or scheduled maintenance.
  4. The use of the Mobile Application as a renewable subscription paid via the Google Play Platform / Apple App Store is commenced by: 1) downloading the Mobile Application on the Google Play Platform / Apple Store, 2) choosing the type of subscription and its duration, 3) making payment for via Google Play / Apple App Store or via a third party intermediary in making payments.
  5. Payment for the monthly subscription of the Mobile Application in the version of the renewable subscription will be taken from the account on the Google Play Platform / Apple App Store or through applications made available by other intermediaries in the payment, in accordance with the choice of subscription made by the User of the Renewable Subscription.
  6. The subscription will renew automatically if it is not canceled at least 24 hours before the end of the current billing period.
  7. The User Account of the Renewable Subscription will be charged within 24 hours before the end of the current billing period the appropriate amount for the renewal, as long as the User of the Renewable Subscription does not cancel it.
  8. The Renewable Subscription User can manage their subscriptions and cancel automatic renewals at any time using the subscription settings in their account settings on the Google Play Platform / Apple App Store.
  9. The Service Provider reserves the right to modify the types, duration and prices of subscriptions offered. In this case, the User of the Renewable Subscription has the right to resign from renewing the renewable subscription for further periods; the current period until its end will be covered by the current rules.

Data Management

  1. Unless it receives Customers prior written consent, Provider: (i) will not access or use Customer Data other than as necessary to facilitate the Service; and (ii) will not give any third party access to Customer Data unless in anonymised or aggregated form, except (iii) when Customer explicitly has marked Customer Data as public. Notwithstanding the foregoing, Provider may disclose Customer Data as required by applicable law or by proper legal or governmental authority. Provider will give Customer prompt notice of any such legal or governmental demand and reasonably cooperate with Customer in any effort to seek a protective order or otherwise to contest such required disclosure, at Customers expense.
  2. Customers Rights. Customer possesses and retains all right, title, and interest in and to Customer Data, and Provider’s use and possession thereof is solely as Customers agent.
  3. Storage and deletion. Provider will store all Customer Data until deleted.
  4. Following termination or deactivation of Customer account, or if Customer removes any User Content from the Fridger app, we may keep your User Content for a reasonable period of time for backup, archival, or audit purposes.

Security

We care about the security of our users. While we work to protect the security of your content and account, Fridger app can’t guarantee that unauthorized third parties won’t be able to defeat our security measures. We ask that you keep your password secure. Please notify us immediately of any compromise or unauthorized use of your account.

Termination

Fridger app may terminate or suspend your right to access or use Fridger app for any reason on appropriate notice. We may terminate or suspend your access immediately and without notice if we have a good reason. If you used the paid subscription, we will refund funds for the unused period.

Other provisions

  1. Notices. Provider may send notifications under this Agreement to the e-mail of the Account, and such communications will be considered received after dispatch.
  2. Change. Provider may modify this Agreement from time to time by posting a revised version on the Fridger app or related Website. Such an amendment will be approved and become effective 30 days after such change, unless the Customer prior to this provides the Provider written notice of rejection of the amendment. Customer’s continued use of the Service after the effective date of an amendment will confirm the Customer’s consent. This Agreement may not be modified in any way other than through an agreement executed by authorized representatives of each party. Notwithstanding the above, Provider may change the AUP or Privacy Policy at any time by posting a new version on its Website, and such amended version will be effective immediately.
  3. Area of Use. The Service is at this stage only allowed to be used in the countries in which it is marketed in Apple Appstore and Google Play.
  4. Add-on Services. The provider reserves the right to offer add-on services in relation to the Service. These will be clearly marked as add-on services and may have a separate price.
  5. Choice of Law & Jurisdiction. This Agreement will be governed solely by Polish law and the choice of venue shall be a court in Poland.

Limitation of Liability

  1. Provider is not responsible for Customer’s misuse of collected data.
  2. Provider is not liable for damages resulting from the misuse of Customer credentials for the Service. All credentials are personal and must be kept safe.
  3. Provider is not responsible for operating loss, loss of business profits or other indirect losses.
  4. Provider is not responsible for the delivery of its services in cases of force majeure, including strikes and lockouts, etc.
  5. Provider’s liability shall be limited such that the compensation to the Customer in any event will not exceed the paid subscription during the term.
